Hawaii: No More Prostitute-Sex Exemption, but Paid Fellatio Remains Legal for Policemen

Hawaii Democratic Senator Clayton Hee would like to put an end to an exemption on the books that allows police officers to have sex with prostitutes for undercover investigations.

The lawmaker and the Honolulu Police Department (HPD) have come to an agreement about changing Hawaii’s decades-old prostitution law by enacting a bill that “would nullify the exemption if the officer agrees to pay a fee for sexual penetration or sadomasochistic abuse.” Technically, the language still allows for officers to receive other kinds of sexual services.

At first they were reluctant. Before a House Judiciary Committee in March, Jason Kawabata, captain of HPD’s Narcotics/Vice Division, defended the police’s privilege arguing that “Even if the intent of the amendment is merely to limit actual conduct by the officer, we must oppose it. Codifying the limitations on an officer‘s conduct would greatly assist pimps and prostitutes in their efforts to avoid prosecution.”
